PREAMBLE
This digital platform is owned and operated by Westpawpets. Throughout this document, the terms “we”, “us”, and “our” refer exclusively to Westpawpets. By accessing our storefront and procuring items from our specialized pet product lines—including Grooming & Tech, Outdoor, and Toys & Training—you enter into a legally binding agreement and agree to be governed by the following Terms of Service (“Terms”).
SECTION 1: PREREQUISITES FOR PLATFORM ACCESS
By engaging with our Services, you affirm that you have reached the age of majority in your primary jurisdiction of residence. You are strictly prohibited from utilizing Westpawpets products for any unauthorized or illicit purposes. Any violation of laws or breach of these Terms shall result in the immediate termination of your access.
SECTION 2: OPERATIONAL INTEGRITY & RESERVATION OF RIGHTS
We maintain absolute discretion to refuse service to anyone at any time. While sensitive payment data is always encrypted via industry-standard protocols, you acknowledge that non-financial data may be transmitted unencrypted to meet technical requirements. Unauthorized reproduction or commercial exploitation of the Service is strictly forbidden.
SECTION 3: DATA ACCURACY & RELIANCE
Westpawpets is not liable for information on this site that may be inaccurate, incomplete, or outdated. Content is provided for general guidance; any reliance upon it is at your own risk. We reserve the right to modify site content at any time without obligation to update historical info.
SECTION 4: FISCAL MODIFICATIONS & SERVICE ADJUSTMENTS
Product valuations and services are subject to adjustment or discontinuation without prior notification. Westpawpets shall not be held accountable for price fluctuations or service suspensions.
SECTION 5: PRODUCT REPRESENTATION & QUALITY
We utilize professional-grade imagery to render accurate representations of our goods. However, because monitor calibrations vary, we cannot guarantee your device’s display will perfectly reflect true materials and pigments. We reserve the right to limit sales quantities per region or individual.
SECTION 6: BILLING FIDELITY & ACCOUNT STEWARDSHIP
We reserve the right to reject any procurement request. You agree to provide current, complete, and accurate purchase and account information for all transactions.
SECTION 7: AUXILIARY THIRD-PARTY TOOLS
Access to elective third-party tools (e.g., trackers, converters) is provided “as is” without endorsement. We assume no liability arising from your use of these optional utilities.
SECTION 8: THIRD-PARTY LINKS
We are not responsible for the content or accuracy of third-party websites linked on our platform. Any engagement with external sites is strictly between you and those entities.
SECTION 9: SUBMISSIONS & TESTIMONIALS
By submitting reviews or suggestions (“Feedback”), you grant Westpawpets a perpetual, royalty-free license to use and distribute such content. We reserve the right to remove content deemed unlawful or offensive.
SECTION 10: DATA GOVERNANCE & PRIVACY
Your submission of personal information is governed by our Privacy Policy. As an AppLovin partner, we uphold rigorous standards regarding data transparency and ethical tracking.
SECTION 11: ERRORS & OMISSIONS
We reserve the right to correct typographical errors or inaccuracies pertaining to descriptions, pricing, or availability, and to cancel orders if information is found to be inaccurate, even after submission.
SECTION 12: PROHIBITED CONDUCT
Malicious use, intellectual property infringement, or the transmission of destructive code is strictly prohibited and will result in immediate legal and service-level repercussions.
SECTION 13: DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
The Service and all products are provided “as is.” In no event shall Westpawpets or its affiliates be liable for any direct or consequential damages arising from your use of our products.
SECTION 14: INDEMNIFICATION
You agree to indemnify Westpawpets and our parent company, ALXIN HONG KONG LIMITED, against any claims arising from your breach of these Terms.
SECTION 15: SEVERABILITY
If any provision is adjudicated to be void or unlawful, such provision shall be severed, and the remaining terms shall continue to be enforceable to the maximum extent permitted by law.
SECTION 16: TERMINATION
These Terms remain effective until terminated by either party. We may terminate your access if we suspect non-compliance with any provision of this agreement.
SECTION 17: ENTIRETY OF AGREEMENT
These Terms and our posted policies represent the complete agreement between you and Westpawpets, superseding all prior communications.
SECTION 18: GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (SAR).
SECTION 19: PLATFORM HOSTING
Our storefront is hosted by Shopify Inc. Your commercial contract is exclusively with Westpawpets; Shopify bears no liability for product quality or safety.
SECTION 20: LOGISTICAL RISK & TITLE
Title and risk of loss for merchandise pass to the customer upon our delivery of goods to the carrier. We are not liable for delays caused by external carriers or customs.
SECTION 21: INTELLECTUAL PROPERTY
All visual assets and designs within the Westpawpets ecosystem are protected by international copyright laws. Unauthorized use is strictly prohibited.
SECTION 22: MANDATORY DISPUTE RESOLUTION
Parties agree to seek informal negotiation via support@westpawpets.com for at least 30 days before seeking formal legal remedy.
SECTION 23: UPDATES TO TERMS
We reserve the right to update these Terms at any time. Continued use of the platform constitutes acceptance of the revised Terms.
